Terms of Use
The legal terms governing your access to and use of the HydroScout platform.
1. Commercial SaaS Scope
HydroScout is licensed as commercial software as a service (SaaS) on a per-seat, per-token basis for professional environmental engineering and hydrogeological screening. Access is provisioned via licensed tokens; each license grants a defined organization a limited, non-exclusive, non-transferable right to use the platform for its internal professional work.
- Licenses are issued to organizations, not individuals, and entitlements (quota, seats, tokens) may not be transferred between organizations except by written agreement.
- Use of exports and generated briefs is restricted to internal feasibility screening and client advisory memorandum attachment.
2. Regulatory Disclaimer — Non-Reliance Clause
HydroScout generates preliminary feasibility assessments only. It is not an official instrument of Alberta Environment and Protected Areas (EPA) or the Alberta Energy Regulator (AER), and it does not replace a formal engineering review or a stamped submission by a qualified Professional Engineer (P.Eng) or Professional Geoscientist (P.Geol). No output may be presented as a regulatory approval, and HydroScout assumes no liability for reliance on screening outputs in place of professional review.
3. Section 81 / Section 82 Water Act Transfers
Actual transfer approvals under Sections 81 and 82 of the Alberta Water Act remain subject to public notice requirements, demonstration of non-impairment of existing licensed rights (and, where applicable, the Crown’s aquatic protection holdback under S.83), and the statutory discretion of the EPA Director. HydroScout’s screening intelligence does not prejudge, guarantee, or substitute for any such approval.
4. Acceptable Use & Anti-Scraping
You agree not to, and not to permit any third party to:
- Reverse engineer or decompile HydroScout’s spatial indices, valuation models, or platform source code, except as expressly permitted by law.
- Share tokens or seats outside your licensed organization or exceed your licensed quota.
- Scrape, bulk-harvest, or re-publish HydroScout’s spatial indices, allocation matrices, or valuation outputs without prior written authorization.
- Use the platform to infringe third-party rights or violate applicable law.
5. Limitation of Liability
HydroScout is provided “as is” without warranties of any kind. To the maximum extent permitted by law, 5th Meridian Digital Consultancy Inc. shall not be liable for indirect, incidental, or consequential damages arising from use of the platform, including any reliance on screening outputs for regulatory or legal decisions.
